Notable Cases

  • Tenants’ Rights.  The firm was retained to appeal the denial of a class certification motion on behalf of 5000 tenants who alleged that their landlords illegally retained portions of their security deposits (Cardamon v. Dominion Courtyard Villas (Fresno Sup. Ct. No. 16CECG01918). After securing class certification on a successful appeal, Mr. Schallert guided the case to an excellent resolution in which participating class members were paid an average of nearly $800.

  • Contractual Rights.  In 2015, the firm represented LocusPoint Networks, which was seeking to specifically enforce the sale to it of a television station for $6.0 million.  LocusPoint Networks, LLC vs. D.T.V., LLC (No. Dist. Cal. 3:14-cv-01278-JSC).  The station was to be sold at the FCC “spectrum auction,” and the defendant sought to renege on the deal because the station was potentially worth many times the contract price.  LocusPoint prevailed on its motion for summary adjudication, and the firm’s client got the television station.

  • Personal Injury.  Serving as second chair to the Law Office of Edward Deason. Mr. Schallert helped secure a jury verdict of over $16 million following a workplace trip-and-fall.  The firm also assisted the Deason law firm in reaching a $6.0 million settlement for a child who was struck in the head by an errant golf ball.  Working in association with The Wagner Law Group, the Firm helped achieve a confidential settlement in a products liability case after the client’s three-wheel vehicle malfunctioned and caused the traumatic amputation of his dominant arm.

  • Civil Rights/Police Shootings.  The Law Office is currently lead counsel in two separate incidents in which Fresno law enforcement personnel shot and killed citizens who suffered from mental illness.
